REAL ESTATE COMMERCIAL LEASES - TENANT REPRESENTATION

 

I. Introduction -

    Rental expenses are a major portion of any company’s budget. More importantly, opportunities gained by the right site selection, or missed by use of an inadequate site affect the gross income.

    Commercial tenants negotiate their leases at distant intervals, not knowing the typical negotiable items, current competition, newly developed technologies, etc. The landlord, on the other hand, operates with a “standard” lease, and knows the current tricks in order to maximize net profits, and hide the tenant’s costs.

II. Fees for Representation.

    While fees can vary to some extent, depending on the particular circumstances, the typical representation contract charges the amount of two month's rent, with 40% of that amount payable upon initial contract, and then 10% every month (minimum six payments).  This allows a long-term relationship, with investigation of requirements and desires, review of multiple options in the market, and negotiation of the best opportunity.
